Before approving your 2027 budget, test whether the business can handle slower customer payments or delayed financing—and decide what would trigger action. Ask for three things: the cash assumptions the plan depends on, the funding gap if those assumptions fail, and a clear timetable for responding.

An Article 9 sale lets a secured creditor dispose of collateral after default through a commercially reasonable process. It may preserve a business or monetize assets outside bankruptcy, but it is not a company-wide wind-down, a blanket release of liabilities, or an automatic free-and-clear sale. This guide explains the process, the limits, and how to compare it with an ABC, receivership, or bankruptcy sale.

An Assignment for the Benefit of Creditors is a process in which an insolvent company voluntarily transfers its transferable, nonexempt assets to an independent assignee, who liquidates them as a fiduciary for creditors and distributes the proceeds by legal priority. This is the explanation every founder should have before the crisis.
